Artikel 1 – Toepasselijkheid

Deze algemene huurvoorwaarden zijn van toepassing op alle reserveringen en huurovereenkomsten betreffende Vakantievilla Sol y Más Moraira, ongeacht via welk boekingskanaal de reservering tot stand komt.

Artikel 2 – Reservering en totstandkoming overeenkomst

1. Een reservering is definitief zodra de verhuurder de boeking schriftelijk (per e-mail) heeft bevestigd en de aanbetaling door de huurder is ontvangen.
2. Bij boekingen via online platforms gelden naast deze voorwaarden ook de algemene voorwaarden van het betreffende platform. In geval van tegenstrijdigheden prevaleren de voorwaarden van de verhuurder, tenzij het platform anders bepaalt.

Artikel 3 – Betaling

1. Aanbetaling: 25% van de totale huursom, te voldoen binnen 5 dagen na boekingsbevestiging.
2. 2^e Betaling: 25% van de totale huursom, uiterlijk 12 weken voor aanvang huurperiode.
3. Restbetaling: uiterlijk 6 weken voor aanvang van de huurperiode.
4. Bij reserveringen binnen 6 weken voor aankomst dient de volledige huursom direct te worden voldaan.
5. Bij niet-tijdige betaling behoudt de verhuurder zich het recht voor de reservering te annuleren.
   

Artikel 4 – Borgsom

1. De huurder betaalt een borg van €500.
2. Deze borg wordt binnen 7 dagen na vertrek terugbetaald, mits er geen schade of extra (schoonmaak)kosten zijn geconstateerd en met aftrek van de verplichte en optionele bijkomende kosten.
3. Eventuele schade of ontbrekende inventaris wordt ingehouden op de borg. Als de borg onvoldoende is wordt het meerdere aan de huurder doorberekend.

Artikel 5 – Verplichte en optionele bijkomende kosten

1. De verplichte eindschoonmaak bedraagt €275 per verblijf.
2. Zwembadverwarming is mogelijk tegen een meerprijs van €25 per dag.
3. De villa wordt verhuurd met opgemaakte bedden bij aankomst en voorzien van 1 strandlaken, 2 grote badhanddoeken en 1 handdoek per persoon.
   De villa wordt tevens voorzien van een keukenpakket bestaande uit: 3 theedoeken,
   1 vaatdoek en een nieuwe spons.
4. Alle verstrekte linnengoed, handdoeken en overige inventaris blijven eigendom van de verhuurder en worden uitsluitend in bruikleen ter beschikking gesteld tijdens het verblijf. Bij vermissing, beschadiging of onjuist gebruik van deze goederen worden de vervangings- en/of herstelkosten ingehouden op de borgsom. Het is niet toegestaan om handdoeken, linnengoed of andere inventaris uit de villa mee te nemen.
5. Extra schoonmaak en wissel van bedlinnen is tegen meerprijs mogelijk.

Artikel 6 – Annuleringsvoorwaarden

1. Indien huurder om welke reden dan ook het gehuurde op de afgesproken datum niet kan, wil of zal aanvaarden, dient hij verhuurder hiervan onmiddellijk in kennis te stellen. Een telefonische mededeling hiervan dient altijd schriftelijk of per email te worden bevestigd aan verhuurder.
2. Indien de huurder de overeenkomst annuleert in de periode tot 12 weken vóór de begindatum van de huurperiode, blijft hij 25% van de huurprijs verschuldigd.
3. Bij annulering tot 6 weken voor de begindatum van de verhuurperiode, blijft huurder 50% van het huurbedrag verschuldigd.
4. Bij annulering binnen 6 weken voor de begindatum van de verhuurperiode, is huurder 100% van het huurbedrag verschuldigd.

1. Indien de huurder pas op de begindatum of tijdens de huurperiode meedeelt géén gebruik (meer) van het gehuurde te zullen maken, blijft hij de volledige huurprijs verschuldigd.
2. Verhuurder adviseert huurder een annuleringsverzekering af te sluiten.

Artikel 7 – Gebruik accommodatie - Huisregels

1. De accommodatie is uitsluitend bestemd voor vakantieverblijf en mag niet worden gebruikt voor feesten, evenementen of commerciële activiteiten zonder schriftelijke toestemming van de verhuurder.
2. Het maximale aantal gasten bedraagt 8 personen, tenzij anders overeengekomen.
3. Roken in de villa is niet toegestaan.
4. Huisdieren zijn niet toegestaan.
5. Huurder dient de nachtrust tussen 23.00 – 08.00 te respecteren.

Artikel 8 – Aankomst en vertrek

1. Inchecken vanaf 17.00 uur.
2. Uitchecken uiterlijk 10.00 uur.
3. Vroege aankomst of later vertrek alleen mogelijk in overleg.

Artikel 9 – Verantwoordelijkheid huurder

1. Huurder is verantwoordelijk voor het juiste gebruik van de accommodatie en inventaris.
2. Schade, verlies of diefstal dient direct te worden gemeld aan de verhuurder.
3. De huurder dient zich te houden aan de huisregels en eventuele aanwijzingen van de beheerder.

Artikel 10 – Aansprakelijkheid verhuurder

1. De verhuurder is niet aansprakelijk voor overmacht, zoals stroomuitval, wateronderbrekingen, natuurrampen of andere storingen buiten zijn invloed.
2. De verhuurder is niet aansprakelijk voor ongelukken, verwondingen of ziektes tijdens het verblijf, noch voor verlies of diefstal van persoonlijke eigendommen.

Artikel 11 – Registratie bij de Spaanse autoriteiten

Conform de Spaanse wetgeving is de verhuurder verplicht de gegevens van alle gasten te registreren bij de Spaanse autoriteiten. De huurder verstrekt daartoe uiterlijk 1 week voor aankomst een kopie identiteitsbewijs van alle reizigers.

Artikel 12 – Toepasselijk recht

Op deze overeenkomst is het Spaans recht van toepassing. Geschillen worden bij voorkeur in onderling overleg opgelost. Indien dit niet lukt, is de rechtbank van Alicante, Spanje bevoegd.

Artikel 13 – Slotbepaling

Deze algemene huurvoorwaarden worden voor of bij de boeking verstrekt en vormen samen met de reserveringsbevestiging de volledige afspraak tussen huurder en verhuurder.

Article 1 – Applicability

These general rental terms and conditions apply to all reservations and rental agreements relating to Sol y Más Moraira Holiday Villa, regardless of the booking channel through which the reservation is made.

Article 2 – Reservation and Formation of the Agreement

• A reservation becomes final once the landlord has confirmed the booking in writing (by email) and the deposit has been received from the tenant.
• For bookings made through online platforms, the terms and conditions of the relevant platform also apply in addition to these terms and conditions. In the event of any conflict, the landlord’s terms and conditions shall prevail unless the platform determines otherwise.

Article 3 – Payment

• Deposit: 25% of the total rental amount, payable within 5 days after booking confirmation.
• Second payment: 25% of the total rental amount, payable no later than 12 weeks before the start of the rental period.
• Final payment: payable no later than 6 weeks before the start of the rental period.
• For reservations made within 6 weeks before arrival, the full rental amount must be paid immediately.
• In the event of late payment, the landlord reserves the right to cancel the reservation.

Article 4 – Security Deposit

• The tenant shall pay a security deposit of €500.
• This deposit will be refunded within 7 days after departure, provided that no damage or additional cleaning costs have been identified, and after deduction of the mandatory and optional additional charges.
• Any damage or missing inventory items will be deducted from the deposit. If the deposit is insufficient, the excess amount will be charged to the tenant.

Article 5 – Mandatory and Optional Additional Charges

• The mandatory final cleaning fee is €275 per stay.
• Pool heating is available at an additional charge of €25 per day.
• The villa is rented with beds made upon arrival and includes 1 beach towel, 2 large bath towels and 1 personal towel per person. The villa is also supplied with a kitchen starter pack consisting of: 3 tea towels, 1 dishcloth and a new sponge.
• All provided bed linen, towels and other inventory remain the property of the landlord and are made available on loan only during the stay. In the event of loss, damage or improper use of these items, replacement and/or repair costs will be deducted from the security deposit. It is not permitted to remove towels, bed linen or any other inventory items from the villa.
• Additional cleaning and a change of bed linen are available at an extra charge.

Article 6 – Cancellation Policy

• If the tenant, for any reason, is unable, unwilling or otherwise unable to take possession of the rented accommodation on the agreed date, the tenant must notify the landlord immediately. Any notification by telephone must always be confirmed to the landlord in writing or by email.
• If the tenant cancels the agreement up to 12 weeks before the start date of the rental period, 25% of the rental price remains payable.
• If the tenant cancels up to 6 weeks before the start date of the rental period, 50% of the rental amount remains payable.
• If the tenant cancels within 6 weeks before the start date of the rental period, 100% of the rental amount remains payable.
• If the tenant informs the landlord only on the start date or during the rental period that the tenant will not make use of the rented accommodation, or will no longer do so, the full rental price remains payable.
• The landlord advises the tenant to take out cancellation insurance.

Article 7 – Use of the Accommodation – House Rules

• The accommodation is intended exclusively for holiday accommodation and may not be used for parties, events or commercial activities without the landlord’s written consent.
• The maximum number of guests is 8 persons unless otherwise agreed.
• Smoking inside the villa is not permitted.
• Pets are not allowed.
• The tenant must respect the quiet hours between 23:00 and 08:00.

Article 8 – Arrival and Departure

• Check-in is available from 17:00.
• Check-out must take place no later than 10:00.
• Early arrival or later departure is only possible by prior arrangement.

Article 9 – Tenant Responsibilities

• The tenant is responsible for the proper use of the accommodation and inventory.
• Damage, loss or theft must be reported to the landlord immediately.
• The tenant must comply with the house rules and any instructions given by the property manager.

Article 10 – Landlord Liability

• The landlord is not liable for force majeure, such as power outages, water supply interruptions, natural disasters or other disruptions beyond the landlord’s control.
• The landlord is not liable for accidents, injuries or illnesses during the stay, nor for loss or theft of personal belongings.

Article 11 – Registration with the Spanish Authorities

In accordance with Spanish law, the landlord is required to register the details of all guests with the Spanish authorities. For this purpose, the tenant must provide a copy of the identity document of all travellers no later than 1 week before arrival.

Article 12 – Governing Law

This agreement is governed by Spanish law. Disputes should preferably be resolved amicably. If this is not possible, the court of Alicante, Spain shall have jurisdiction.

Article 13 – Final Provision

These general rental terms and conditions are provided before or at the time of booking and, together with the booking confirmation, constitute the entire agreement between the tenant and the landlord.
